BEFORE: KEITH, MERRITT, and JONES, Circuit Judges Order This appeal has been referred to this panel pursuant to Rule 9(a), Rules of the Sixth Circuit. Appellants have filed their notice of appeal from the December 24, 1980 judgment that dismissed their civil action against two defendants and the January 16, 1981 order denying reconsideration and leave to file an amended complaint. At that time the action was still proceeding against the defendant Tennessee Valley Authority. The judgment contains neither an ""express determination that there is no just reason for delay"" nor expressly directs entry of final judgment as required by Rule 54(b), Federal Rules of Civil Procedure. William B. Tanner Co., Inc. v. United States, 575 F.2d 101 (6th Cir. 1978); Moody v. Kapica, 548 F.2d 133 (6th Cir. 1978). Additionally, there has been no certification of the December 24 judgment pursuant to 28 U.S.C. § 1292(b) which would allow this Court to entertain an appeal from a non-final judgment.
